
Right to Repair
On behalf of numerous clients, BCB lobbied for flexibility and consistency with other states’ laws relative to the safeguarding of consumers’ personal information. Chapter 82 of the Acts of 2007 was the first law in the Commonwealth focused specifically on the subject matter and required a lengthy regulatory process that was carried out by the Office of Consumer Affairs and Business Regulation (201 CNR 17.00).
The Right to Repair was an intense lobbying effort that pitted automobile manufacturers against the after-market parts industry and after 5 years of heavy lobbying and on ballot initiative, both sides could claim some victory. Upon its final enactment in 2013, the law became a de facto federal statute and set the standards for manufacturers across the country. BCB’s client GM secured, through discussions at the highest levels, a key provision that precluded telematics from the scope of the law and protected this critical tool for manufacturers.
